These Terms of Service ("Terms") govern your access to and use of the trycollateral.com website and any related services (collectively, the "Services") offered by Active Margin Group LLC, doing business as Collateral ("Collateral," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Collateral is a referral service that connects business owners with independent licensed insurance agents.
Collateral is not an insurance company, agency, or licensed insurance producer. We do not sell, solicit, or negotiate insurance. We do not issue policies, underwrite risks, bind coverage, or handle claims. All insurance products are offered, quoted, and sold exclusively by licensed insurance agents.
Collateral does not provide insurance advice or recommendations regarding specific coverage, carriers, premiums, or policy terms. Any decisions about insurance should be made in consultation with a licensed insurance agent.
You must be at least 18 years old and authorized to act on behalf of the business for which you are requesting insurance quotes or information. By using the Services, you represent that you meet these requirements.
When you submit information through our site — including through a quote request form or the Coverage Gap Assessment — you authorize us to share your contact information and business details with one or more licensed insurance agents in our network. Those agents may contact you by phone, email, or text to follow up and prepare quotes.
You are under no obligation to purchase insurance from any agent we refer you to. Any insurance transaction is strictly between you and the licensed agent or carrier.

By submitting your contact information through our site, you consent to be contacted by Collateral and by licensed agents in our network by phone, email, and text message — including through autodialed or prerecorded calls or texts — at the number you provide, for the purpose of following up on your request. You can opt out of marketing communications at any time. Standard message and data rates may apply.
Collateral does not guarantee that you will receive quotes, that quotes will result in coverage, or that any quote will be the lowest available price. Any savings estimates, risk scores, or assessments provided through our Services (including through the Coverage Gap Assessment) are general informational tools and are not a substitute for a professional insurance review by a licensed agent.
The Services may contain links to third-party websites or include interactions with third-party agents or service providers. Collateral is not responsible for the content, products, services, privacy practices, or conduct of any third party. Your dealings with any third party — including licensed agents we refer you to — are solely between you and that third party.
All content on the Services — including text, graphics, logos, software, and the Coverage Gap Assessment — is owned by Collateral or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, or create derivative works from any of our content without our prior written permission.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Services.
To the maximum extent permitted by law, Collateral and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services — even if we have been advised of the possibility of such damages.
In no event shall Collateral's total liability arising out of or related to these Terms or the Services exceed one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless Collateral and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any inaccurate or false information you submit to us.
We may suspend or terminate your access to the Services at any time, for any reason, without notice. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Worcester County, Maryland, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date above and, where appropriate, by providing additional notice. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms.
